ताबा सूचना (स्थावर मालमत्तेकरिता) (नियम- ८(१)) ज्याअर्थी, बँक ऑफ महाराष्ट्रच्या प्राधिकृत अधिकाऱ्यांनी सीक्युरिटायझेशन ॲन्ड रिकन्स्ट्रक्शन ऑफ फायनान्शिअल असेट्स अॅन्ड एन्फोर्समेंट ऑफ सीक्युरिटी इंटरेस्ट अॅक्ट २००२ अनुसार अनुच्छेद १३ (४) व १३ (१२) सहवाचन सीक्युरिटी इंटरेस्ट (एन्फोर्समेंट) रूल्स, २००२ च्या नियम ३ अंतर्गत प्राप्त अधिकारांचा वापर करून कर्जदार १) मे. सकाळ इंजिनिअर्स, २) श्री. नितिन बाबूलाल शहा, ३) श्री. प्रशम नितिन शहा यांना सदर सूचनेत निर्देशित रक्कम रु. १,३२,२२,७५६/- अधिक दि. २९.०५.२०२४ पासून लागू न केलेले व्याज व व्याज आदी सहित कंत्राटी दराने व्याज व प्रासंगिक खर्च, मूल्य, केलेले खर्च आदी रकमेचे प्रदान सदर सूचनेच्या प्राप्तीच्या तारखेपासून ६० दिवसांच्या आत करण्याचे निर्देश देणारी मागणी सूचना दि. ३०.०५.२०२४ रोजी सदर कायद्याच्या अनुच्छेद १३ (२) अंतर्गत जारी केली होती... कर्जदार १) मे. सकाळ इंजिनिअर्स, २) श्री. नितिन बाबूलाल शहा, ३) श्री. प्रशम नितिन शहा यांनी सदर रकमेचा भरणा करण्यास कसूर केली असल्याने, सदर सूचना वरील कर्जदार व हमीदार व आम जनतेस देण्यात येत आहे की, अधोहस्ताक्षरितांनी सदर कायद्याच्या अनुच्छेद १३ च्या उप अनुच्छेद (४) सहवाचन सीक्युरिटी इंटरेस्ट (एन्फोर्समेंट) रूल्स, २००२ च्या नियम ८ अंतर्गत त्यांना प्राप्त अधिकारान्वये बँक ऑफ महाराष्ट्र खालील निर्देशित मालमत्तेचा दि. १२.०९.२०२४ रोजी प्रतिकात्मक ताबा घेतला आहे. विशेषत: कर्जदार व हमीदारांनी आम जनतेस इशारा देण्यात येत आहे की, त्यांनी सदर मालमत्तेसंदर्भात व्यवहार करू नये व असे कोणतेही व्यवहार हे बँक ऑफ महाराष्ट्र, यांच्या प्रभारांतर्गत रक्कम थकित रकमेच्या तारखोपर्यंत अधीन असेल.
कायद्याच्या अनुच्छेद १३ च्या उप- अनुच्छेद ८ च्या तरतुदी अंतर्गत कर्जदारांचे लक्ष वेधून घेण्यात येत आहे की त्यांनी उपलब्ध वेळेमध्ये प्रतिभूत मालमत्ता सोडवून घ्यावी.

Notice of Possession (for immovable property) (Rule-8(1)) means, by the authorized officers of Bank of Maharashtra Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act 2002 read with Section 13 (4) and 13 (12) of Security Interest (Enforcement) ) Borrower in exercise of powers conferred under Rule 3 of Rules, 2002 1) May. Sakal Engineers, 2) Shri. Nitin Babulal Shah, 3) Shri. To Prasham Nitin Shah the amount directed in the said notice is Rs. 1,32,22,756/- plus Rs. Demand notice directing to provide interest at contractual rate including unapplied interest and interest etc. and incidental expenses, value, expenses etc. within 60 days from the date of receipt of the said notice. Issued under Article 13 (2) of the said Act on 30.05.2024... Debtor 1) May. Sakal Engineers, 2) Shri. Nitin Babulal Shah, 3) Shri. As Prasham Nitin Shah has defaulted in payment of the said amount, notice is hereby given to the above creditors and guarantors and to the general public that under Rule 8 of the Security Interest (Enforcement) Rules, 2002 read with sub-section (4) of Article 13 of the said Act, the undersigned shall By virtue of the powers conferred upon them by the Bank of Maharashtra, the following directed property dt. Symbolic possession has been taken on 12.09.2024. In particular, the borrowers and guarantors are cautioned to the general public that they should not transact in respect of the said property and any such transaction shall be subject to the charge of Bank of Maharashtra, up to the due date.
Under the provision of Sub-Article 8 of Article 13 of the Act, the attention of the borrowers is drawn to redeem the secured property within the available time.
