| तुम्ही खाली नमूद केलेले कर्जदार अनुसूचीत नमूद केलेली मालमत्ता गहाण ठेवून कर्ज सुविधेचा लाभ घेतला आहे आणि तुम्ही खाली नमूद केलेले कर्ज करारनाम्याकरिता कर्जदार / सह-कर्जदार / जामीनदार म्हणून आहात. परिणामी तुम्ही केलेल्या कसुरीमुळे तुमच्या कर्ज खात्याचे वित्तिय मत्तेची सुरक्षितता आणि पुर्नरचना आणि सुरक्षा हीत कायदा, 2002 (संक्षिप्तात "सर्फेसी कायदा" ) च्या तरतुदीअंतर्गत नॉन परफॉर्मिंग अॅसेट म्हणून वर्गीकरण करण्यात आले आहे. आम्ही हिंदूजा हाउसिंग फायनान्स लिमिटेडने तुम्ही दिलेल्या पत्यावर सर्फेसी कायद्याच्या कलम 13 ( 3 ) यासह वाचलेल्या कलम 13 (2) अंतर्गत मागणी सूचना निर्गमित केली आहे. रजिस्टर्ड पोस्ट / ब्लू डार्ट कुरिअरद्वारा तुम्हास पाठविलेल्या सूचना पोचवणी न होताच परत आल्या आहेत व पुन्हा स्वीकारल्या आहेत. उक्त सूचनांमधील समाविष्ट मजकूर असा आहे की तुम्ही तुमच्याद्वारा हमी दिलेल्या विविध कर्जाचे प्रदान करण्यात कसूर दाखविली आहे. त्यामुळे, सर्फेसी कायद्याच्या कलम 13 (2) च्या तरतुदीनुसार सूचना देण्याकरिता आणि सुरक्षा हीत (अंमलबजावणी) नियम, 2002 च्या नियम 3 (1) च्या तरतुदींच्या अनुसार सद्य प्रसिद्धी देण्यात आली आहे:

तुम्हास याद्वारा व्याज व खर्च यासह पूर्वोक्त नमूद केलेली रकमेचे या सूचनेच्या प्रसिद्धीच्या तारखेपासून 60 दिवसांच्या कालावधीच्या आत हिंदुजा हाउसिंग फायनान्स लिमिटेडल प्रदान करण्यास फर्माविण्यात आले आहे, त्यास असमर्थ ठरल्यास त्याकरिता हिंदुजा हाउसिंग फायनान्स लिमिटेड कर्जदार, गहाणकार व हमीदारांच्या सुरक्षित मत्तेचा ताबा घेवून समाविष्ट सर्व किंवा कोणतेही एक किंवा अधिकतम सुरक्षित मत्तेच्या अनुसार उक्त कायद्याच्या तरतुदीअंतर्गत आवश्यक कारवाई करील. उक्त कायद्याअंतर्गत हिंदुजा हाउसिंग फायनान्स लिमिटेडला पुढील समाविष्ट अधिकार उपलब्ध आहे (1) सुरक्षित मत्ता सोडविण्याकरिता भाडेपट्टा, विक्रिचे अभिहस्तांकनाद्वारा हस्तांतरणाबाबत हक समाविष्ट कर्जदार / हमीदारांच्या सुरक्षित मत्तेचा ताबा घेण्याचा अधिकार (2) हिंदूजा हाउसिंग फायनान्स लिमिटेड द्वारा सुरक्षित मत्तेबाबत कोणतेही आणि सुरक्षित मत्ता विकून वसूली करण्याचा आणि भाडेपट्टा, अभिहस्तांकन किंवा विक्रिद्वारा हस्तांतरणाकरिता हक्क समाविष्ट सुरक्षित मत्तेचे व्यवस्थापन हाती घेण्याचा व हस्तांतरित सुरक्षित मत्तेसंबंधीत सर्व हक निहित आहेत. उक्त कायद्याच्या कलम 13 (13) च्या तरतुदींच्या अनुसार, तुम्हास याद्वारा हिंदुजा हाउसिंग फायनान्स लिमिटेडच्या पूर्व- समंतीशिवाय हिंदुजा हाउसिंग फायनान्स लिमिटेडकडे तारणगहाण असलेल्या / गहाणवट असलेल्या आणि वर संदर्भित केल्यानुसार कोणतीही सुरक्षित मत्तेची विक्रि, भाडेपट्टा किंवा अन्य कोणत्याही त-हेने ( तुमच्या व्यवसायाच्या सामान्य रीतीखेरीज) हस्तांतरणाकरिता प्रतिबंधित करण्यात आले आहे.
